By downloading, accessing, or using Local Bounty Marketplace (the "App"), localbountymarketplace.com or aedynamicsllc.com (the "Websites"), you agree to be bound by these Terms and Conditions ("Terms"), our Privacy Policy, and our Content Policy & Community Guidelines (collectively, the "Policies"). If you do not agree, do not use the Platform. These Terms form a binding agreement between you and A&E Dynamics LLC.
You must be at least 16 years old to create an account or use the Platform. By using the Platform, you represent that you meet this requirement and have legal capacity to enter into these Terms. If you are under 18, you confirm that you have parental or guardian consent.
To access most features, you must register for an account. You agree to provide accurate, complete, and updated information. You are responsible for safeguarding your account credentials. We reserve the right to suspend, restrict, or terminate accounts at any time, with or without notice, if you violate these Terms or if we determine it is in the best interest of the Platform.
Users may upload product listings, text, images, or other material ("User Content"). You represent and warrant that you have all rights to such content and that it does not infringe third-party rights. By posting content, you grant A&E Dynamics LLC a worldwide, royalty-free, non-exclusive, sublicensable license to host, use, reproduce, distribute, and display your content solely in connection with operating the Platform. We reserve the right, but are not obligated, to remove or restrict access to any User Content at our sole discretion.
A&E Dynamics LLC does not endorse, verify, or guarantee the accuracy, legality, or safety of any User Content. Users are solely responsible for their own content, listings, and interactions.
Sellers are solely responsible for the safety, legality, labeling, quality, and compliance of their products. Sellers represent and warrant that their products comply with all applicable federal, state, and local laws (including but not limited to food safety, labeling, and licensing requirements). This includes ensuring compliance with any state-specific prohibitions (e.g., selling raw milk where prohibited, or selling food without proper certification).
A&E Dynamics LLC does not manufacture, store, inspect, or guarantee any products listed through the Platform. Any disputes, claims, or damages arising from products are strictly between buyers and sellers.
All users must comply with our Content Policy & Community Guidelines, which are incorporated by reference into these Terms. You agree not to use the Platform to:
Users are individually responsible for ensuring that their listings and activities comply with all applicable laws and regulations in their own state, county, or country. Violation may result in suspension or permanent termination of your account.
Flagging or reporting a listing does not guarantee its removal. We may review flagged content and act at our discretion.
Subscriptions are processed exclusively through the App Store provider (e.g., Apple App Store, Google Play). You agree to comply with the applicable App Store terms. Refunds: Except as required by law or App Store policy, all purchases are non-refundable. Refunds may be granted only in exceptional circumstances at our sole discretion. No free trials are currently offered.
The Platform and its content (excluding User Content) are the property of A&E Dynamics LLC or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Platform for personal, non-commercial purposes. You may not copy, modify, distribute, sell, or reverse engineer any part of the Platform.
The Platform is provided "as is" and "as available." We make no representations or warranties of any kind, express or implied, regarding the operation of the Platform, products listed by users, or the accuracy of content. We disclaim all warranties, including merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.
To the maximum extent permitted by law: A&E Dynamics LLC and its officers, employees, affiliates, and agents are not liable for any indirect, incidental, consequential, punitive, or special damages, including loss of profits, data, goodwill, or business opportunities. Our total liability for any claim related to your use of the Platform shall not exceed the lesser of $100 or the total fees paid by you to us in the six (6) months prior to the event giving rise to the claim. Informal Negotiations: Before filing a claim, you agree to attempt resolution by emailing support@aedynamicsllc.com. Arbitration: If unresolved, disputes will be submitted to binding arbitration under the American Arbitration Association. Class Action Waiver: You waive the right to participate in any class, consolidated, or representative action. Arbitration Costs: If arbitration fees are deemed excessive, A&E Dynamics LLC will cover the excess. Jurisdiction: These Terms are governed by the laws of the State of Oregon, United States.
We may suspend or terminate your account, restrict access, or remove content at any time without notice if we believe you violated these Terms or for any other reason at our discretion.
We may update these Terms at any time. The revised version will be effective upon posting. Continued use of the Platform constitutes acceptance of the updated Terms.
If any provision of these Terms is held invalid, the remaining provisions shall remain in full effect.
These Terms, together with our Privacy Policy and Content Policy & Community Guidelines, constitute the entire agreement between you and A&E Dynamics LLC regarding your use of the Platform.
